USER AGREEMENT Welcome To Westward Plastics - To ensure maximum clarity in the use of our web site facility, we have created the following guidelines that apply to every aspect of Westward Plastics web site. Your use of Westward Plastics web site constitutes your agreement to abide by the following rules. The following User Agreement ("Agreement") governs the use of the Westward Plastics web ("Company" and "Vendor") site ("Site"). Please read the rules contained in this Agreement. You can access this agreement at various points throughout the Site. Your use of the Site will constitute your agreement to comply with the rules stated here in. If you cannot agree with these rules, please do not continue using the Site. Westward Plastics expressly reserves the right to revise the rules contained in this Agreement. You are encouraged to periodically visit this page to review the rules. Notice of revisions to this agreement will be announced on this page. Continued access of the Site will constitute your acceptance of the changes or revisions to the Agreement. Use Of The Material By You - Westward Plastics authorises you to view and use the material on this Site solely for your personal, non-commercial use. The content of this Site such as text, graphics, images, and other materials ("Materials"), are protected by copyright under both England & Wales and foreign law. Unauthorised use of the material may violate copyright, trademark, and other laws. You must retain all copyright and other proprietary notices contained in the original Materials and on any copies you make of the Material for your personal use. You may not sell or modify the Material in any way for any public or commercial purpose. The use of the Material on any other web site or in any networked computer environment for any purpose is prohibited. If you violate the terms of this Agreement, Westward Plastics and Service Provider reserve the right to terminate your access to the Site, and you must immediately destroy any copies you have made of the Material. Links To Other Sites - As a convenience to you, we may occasionally provide links to other sites where we feel it is appropriate. Our decision to link to third party sites is not an endorsement of the content in the linked site. We are not responsible for the content of linked third-party sites, nor do we make any representations regarding the content or accuracy of material on third party sites. If you decide to access linked third-party sites, you do so at your own risk. General - If you access the Materials outside the United Kingdom, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. The internal and substantive laws of England and Wales without regard to its conflict of laws and principles govern this Agreement. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such terms or any other terms. Contracts - This does not affect your statutory rights as a consumer. Consumer Law - We agree to meet the obligations set out under the consumer protection laws currently in
force, which includes; Order Cancellations - You have the right to cancel your order at any time before a confirmed delivery date free of charge. You have the right to cancel your order within 7 working days after receiving your products without giving a reason providing the goods are in a re-saleable condition. The 7 working day cancellation period begins the day after receipt of those goods and you are required to notify us in writing within this time. You are however responsible for the safe return of the product to us, including the cost of doing so. We can obviously arrange this on your behalf at a cost equal to the original delivery cost, except where certain additional requirements are made, for which the additional cost will be advised & passed on. If you have decided to cancel your order or wish to return your products to Westward Plastics we will refund your credit card within 30 days of cancellation. This section has been introduced to incorporate the new European Directive on distance selling which is incorporated into UK law by the Consumer Protection (Distance Selling) Regulations 2000. Termination - Westward Plastics possess the right to terminate your ability to access the Site for any
reason, without notice. As a user, you are responsible for your own communications and are solely responsible for the consequences of
their posting. You must not do the following: Entire Agreement - All services provided to you by Westward Plastics are subject to these terms together with any previous written or verbal representations given or made by Westward Plastics or any representatives of Westward Plastics. Thank you for taking the time to review the terms and conditions of use for Westward Plastics. We encourage you to periodically review these rules to keep yourself apprised of any revisions to this Agreement. If you do not agree to the terms contained in this Agreement, please exit the Site. These terms and conditions do not affect your statutory rights as a consumer. Privacy Policy Statement - We at Westward Plastics are committed to protecting your privacy. We will
only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information
about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service. We will not e-mail you
in the future unless you have given us your consent. The type of information we will collect about you includes: Your Consent - By submitting information to Westward Plastics, you consent to the collection and use of this information by Westward Plastics and its Service Provider. If we decide to change our privacy policy, we will post those changes on this page so that you are aware of what information we collect, how we use it and under what circumstances we disclose it. Data Security - We have designed our site to protect the information we collect online from unauthorised access. We safeguard your private information by implementing the appropriate physical, electronic and managerial procedures necessary to protect your privacy. You can correct factual errors in your personal information on orders or as a member of Westward Plastics by sending us a request that credibly shows the data's inaccuracy. To further protect your security, we also take the reasonable steps to verify your identity before granting access to your personal profile or making data changes. Improving Our Service - Westward Plastics does not sell, trade or rent your personal information to others. To better tailor our services to our customers' needs, we use non-identifying and aggregate information to help us make decisions on how to improve Westward Plastics. Description Of Goods - All the products we sell are of a technical nature and it is not practical to publish detailed specifications of all the products. All images, descriptive matter, specifications and advertising on our site are for the sole purpose of giving an approximate description of the goods. Full detailed specifications are available from the manufacturer's brochures or their websites. Payment And Price - The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. We are entitled to make adjustments to the price to take account of any increase in our supplier's prices. Also if the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. We will inform you of the correct price and give you the opportunity to cancel the order. If we are unable to contact you we will treat the order as cancelled. All prices on our website are inclusive of VAT but exclusive of delivery charges which will be payable as indicated at the time of placing your order. Typographical Errors - In the event a product is listed at an incorrect price due to typographical error, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account in the value of the incorrect price (including delivery charges). Availability Of Goods - All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods. Delivery - Westward Plastics always endeavours to adhere to delivery estimates but they are unfortunately estimates and with the best will in the world and the most efficient systems, things sometimes do go wrong, very often outside of our control. Any dates we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods and time is not of the essence. Returns Policy For Westward Plastics - At Westward Plastics we want you to be satisfied every time you shop with us. Occasionally however, we know that you may want to return items. To help you with this process please see our returns policy below. Returning An Item - Damage - In the unlikely event you should receive your goods damaged we will arrange a replacement item for you. It is your responsibility to notify us within 72 hours of receipt that an item has been received damaged (please see risk below). Please check quantity of pieces delivered against the carrier’s paperwork and note shortages against the carrier’s documentation. Returning An Item - Risk - As soon as the product(s) have been delivered to your door, you, the customer, are responsible for said goods. We will only deliver goods to the address on the order and goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk. Any transit damage to the goods, shortages or incorrect goods supplied must be noted on the delivery consignment note at the time of delivery. Returning An Item - Incorrect / Non delivery - If you receive incorrect goods it is your responsibility to notify us within 72 hours of receipt at which point we will make the necessary arrangements. We can only accept liability for non-deliveries if we are notified within 3 days of the advised/anticipated delivery date. Returning An Item - Faulty - In the unlikely event that your goods are faulty on delivery, or within 28 days of receipt, please contact our sales office department on 0117 935 8058 within 72 hours of receipt of goods. If we arrange collection you will be issued with a unique number against which to return the product. Please be aware you are responsible for ensuring the product is suitably packaged for return. The goods must be returned in the original packaging. The cost of any damage caused due to insufficient packaging will be charged to you. This charge will be at least 15% of the purchase value. Once the goods are received back in our premises the fault will be verified and a replacement order will be sent out to you. This does not apply to faults caused by accident, neglect or misuse, for which there will be no refund or exchange. Cancelling An Item - You have the right to cancel your order at any time before a confirmed delivery
date or prior to despatch, free of charge. The United Kingdom’s Distance Selling Regulations stipulate that as a consumer, you have
the right to cancel the contract for the purchase of any item within seven working days of delivery. This applies to all of our products.
